1. Tell Congress to Vote "YES" on In-State Tuition: On Monday, the House is scheduled to vote on its in-state tuition bill for veterans, H.R. 357. The VFW has heard from countless veterans who were disqualified from receiving in-state tuition at public schools simply because their past military obligations did not conform with their state's stringent residency requirements. The VFW believes that no veteran should be penalized for his or her military service when seeking higher education, which is why we have mobilized to get federal legislation enacted to offer recently-transitioned veterans in-state tuition protections when using their earned GI Bill benefits. Contact your member of Congress today and urge them to vote "YES" on H.R. 357 and offer in-state tuition protection for college-bound veterans. 2. New GI Bill Complaint System Launched: VFW applauded this week's rollout of a new consolidated complaint system to help VA and its agency partners weed out fraud and abuse within educational institutions that serve student veterans. The new system, which VFW National Commander Bill Thien called a "game changer," is something VFW has made part of its education reform priorities for the last two years. It will allow veterans, service members and eligible dependents who use GI Bill benefits, military Tuition Assistance, or other federal aid the ability to report fraud, waste and abuse securely online. The new complaint process was one of two major consumer resources set into motion by a 2012 presidential executive order and codified through the Improving Transparency in Education for Veterans Act of 2012. 3. Destroying Syria's Chemical Weapons: The Motor Vessel Cape Ray deployed this week to the Mediterranean on a mission to destroy Syria's chemical weapons stockpiles. Onboard are a mix of 35 civilian mariners, more than 60 chemical specialists from the Army's Edgewood Chemical Biological Center at Fort Aberdeen, Md., and a U.S. Marine Corps security detail. According to a special DOD briefing provided for the VFW and other veteran and military service organizations, the team will use a Field-Deployable Hydrolysis System to destroy deadly chemicals that have been identified as Sarin, VX and Mustard Gas. The destruction will be nearly 100 percent, and the effluent produced will be similar in toxicity to normal household cleaners. DOD responded to our concerns for the welfare of those involved in the operation, and the crew is well aware of the potential risks to exposure, and possible threats to ship security. Pre-deployment physicals, blood tests, and post-deployment monitoring are part of the personnel action plan. The operation is expected to take about 90 days, and helps to fulfill part of VFW National Resolution 403 to halt the spread of weapons of mass destruction. 4. SASC Holds COLA Hearing: The Senate Armed Service Committee held a hearing Tuesday on the one-percent COLA penalty that the VFW other veteran and military service organizations oppose. Testifying for the government were Acting Deputy Secretary of Defense Christine Fox and Adm. James Winnefeld, the Vice Chairman of the Joint Chiefs of Staff, who said DOD was not consulted on the COLA penalty that the Bipartisan Budget Agreement levied on working-age military retirees younger than age 62. Regarding pay, the Pentagon said it cannot sustain the rate of growth in military compensation that has occurred over the past decade, and that any subsequent changes will not reduce any military take-home pay. They support allowing the ongoing Military Compensation and Retirement Modernization Commission to finish its report, which is due the president in February 2015. They also support grandfathering all military retirees and those currently serving from any future change to the military retirement system. In a statement submitted for the record, VFW Executive Director Bob Wallace wrote that "penalizing military retirees for serving too well and for too long is not a solution" to saving the government money, and that it could jeopardize the integrity and viability of the All-Volunteer Force, "which is a cost this nation cannot afford." 5. House Discusses Veterans' Employment: The House VA Committee held a hearing this week to examine one of its top priorities: employment opportunities for veterans. Witnesses from several major corporations, to include Wal-Mart, Microsoft, JP Morgan Chase, as well as the International Franchise Association and the U.S. Chamber of Commerce, discussed their efforts towards recruiting, hiring and promoting veterans. Committee members asked panelists to comment on federally-funded training and hiring programs, and changes that may be needed to create more growth opportunities for those currently transitioning out of the military. 6. Army Chief of Staff Update: The VFW attended a meeting with Army Chief of Staff Gen. Raymond Odierno and his senior staff regarding the current state of the Army and the challenges that lay ahead as the result of unknown budgets for the active Army and its Guard and Reserve components; downsizing efforts that worst case could reduce the active Army to as low as 420,000 soldiers instead of the planned 490,000; the impact of an increased operations tempo in Afghanistan, Africa and elsewhere; and the need to maintain faith with soldiers and families during this time of change. Regarding compensation, he said the military retiree COLA penalty in the Bipartisan Budget Agreement came as a surprise, and wants the ongoing Military Compensation and Retirement Modernization Commission to submit a package recommendation instead of piecemeal deals to slow the growth in military or retiree compensation. The general's top five priorities are to continually develop Army leaders; to remain globally responsive and revive an expeditionary mindset; to maintain a ready and modern Army; to strengthen the Army's commitment to its soldiers; and to maintain the All-Volunteer Force.

7. Vietnam Waters Ship List: VA continually updates its list of Navy and Coast Guard ships that operated in Vietnamese waters to help veterans document claims for presumptive illnesses related to exposure to Agent Orange or other herbicides. Veterans must meet VA's criteria for service in Vietnam---to include being aboard boats on the inland waterways or brief visits ashore---to be presumed to have been exposed to herbicides. 8. Two Korean War MIAs Identified: The Defense POW/MIA Office has announced the identification of remains belonging to two soldiers. They are:
* Pfc. James R. Holmes, Company K, 3rd Battalion, 24th Infantry Regiment, 25th Infantry Division, was lost Dec. 1, 1950, in North Korea. He was accounted for on Jan. 14 and will be buried with full military honors in Arlington National Cemetery in May.
* Cpl. Cristobal Romo, Company L, 3rd Battalion, 31st Infantry Regiment, 7th Infantry Division, was lost Dec. 12, 1950, in North Korea. He was accounted for Jan. 13 and will be buried with full military honors in Riverside, Calif., on March 22.

VFW Legislative Alert: Tell the House to vote "YES" on Veterans' In-State Tuition


Background: For the last year, the VFW and its partners have pushed Congress to offer in-state tuition protection for student veterans attending public colleges and universities. Next week, the House of Representatives is scheduled to vote on its veterans' in-state tuition bill, H.R. 357, which means we may be one step closer to ensuring our student veterans have access to the quality, cost-effective education we promised them.

In 2008, the VFW and its partners helped pass the Post-9/11 GI Bill with the intention of allowing Iraq and Afghanistan-era veterans to go to college for free at the public school of their choice. Sadly, many of our student-veterans cannot take full advantage of this opportunity because of outdated public education policies.  Many veterans may be disqualified from receiving in-state tuition simply because their past military obligations do not conform to the state's stringent residency requirements. This often forces veterans to either take out burdensome student loans, attempt to balance full-time employment with full-time education, or abandon their higher education dreams altogether. Though the veterans' community has successfully convinced some states to fix this in-state loophole for veterans, most states still fall short.

The VFW believes that no veteran should be penalized for his or her military service when seeking higher education, which is why we have mobilized to pass federal legislation that will protect our recent veterans who want to go back to school through our "In State 4 Vets" campaign alongside Student Veterans of America and the American Legion. Action Needed: Contact your member of Congress today and tell them to vote "YES" next week on H.R. 357. This legislation offers critical in-state tuition protections for our recently-separated veterans looking to go to college on the GI Bill. Remind Congress that we should never allow government-subsidized colleges and universities to shortchange our veterans on their education. Our veterans defended our nation – not just a particular state – which is why we encourage the House or Representatives to come together and pass reasonable in-state tuition standards for all of our college-bound veterans through H.R. 357.

1. Comprehensive Veterans Bill Needs Your Support: VFW-supported legislation to expand and improve healthcare and benefits for all generations of veterans and their families was introduced by Senate VA Committee Chairman Bernie Sanders (I-Vt.). S. 1950, the "Veterans Health and Benefits and Military Retirement Pay Restoration Act of 2014," fulfills many VFW's priority goals, to include expanding family caregiver benefits, in-state tuition rates and the veterans retraining assistance program, and would provide advance appropriations for mandatory VA accounts so that disabled veterans, survivors and GI Bill recipients would continue to receive their monthly payments regardless of future government shutdowns. The bill would also repeal the 1 percent COLA penalty on working-age military retirees younger than age 62. VFW National Commander Bill Thien called it "The most comprehensive veterans' legislation to be introduced in decades," and is now urging all VFW members and advocates to contact their members of Congress to support S. 1950. 2. VA Warns of Pension Poaching Scams: The VA is warning everyone of potential pension poaching scams. Be cautious if someone offers to move your assets around in order for you to qualify for VA pension. This type of scam is often directed toward veterans and family members who "do not" actually qualify for VA pensions. Other examples:

  • Organizations who cold-call veterans or survivors, charge money for assisting with a VA pension claim, and take credit card information from veterans over the telephone.
  • People who charge as much as $6,000 upfront to represent claimants before VA, with a percentage of any eventual back payment from VA as a portion of the ultimate fee.

Please note that VFW's nationwide cadre of VA-accredited service officers assist all eligible veterans and survivors for free, and last year helped 125,000 veterans to recoup $3.7 billion in earned benefits. 3. TRICARE to Close 189 Walk-In Facilities: On April 1, TRICARE will close 189 walk-in facilities in the United States. The reasons giving are the majority of beneficiaries use the Internet or phone to make changes, and that closing the contractor-operated CONUS facilities would save $254 million over five years.  The change does not affect TRICARE benefits or healthcare services, and overseas walk-in facilities will remain open. According to TRICARE officials, all of the administrative services that walk-in TSCs currently provide can be handled by TRICARE websites, mobile apps and toll-free phone centers. Beneficiaries can do the following on the TRICARE website:

    • Enroll in or purchase a plan

    • File a check or claim

    • View referrals and prior authorizations

    • Find a doctor

    • Change primary care managers

    • See what services and procedures are covered by their health plans

    • Compare plans

    • Manage prescriptions



4. New Service Members Mortgage Protections: The Consumer Financial Protection Bureau has written new rules to protect service members and their families from serious financial challenges. According to the CFPB, more than a third of the complaints from military families are mortgage-related, including poor mortgage servicing, sloppy lender recordkeeping, and inconsistent foreclosure practices. Some of the changes being implemented will address the worst problems in the mortgage servicing industry, and provide new rights and protections to borrowers with an emphasis on military families. 5. New Bergdahl Video Surfaces: A new video surfaced this month showing Army Sgt. Bowe Bergdahl, the only known American service member being held against his will. It is the sixth known video to show him in captivity after being captured in eastern Afghanistan by the Taliban on June 30, 2009. They initially demanded $1 million and the release of 21 Afghan prisoners being held at Guantanamo Bay. The Taliban later reduced their demand to five prisoners in exchange for Bergdahl. This is an extremely difficult situation for the U.S. Government. Bergdahl is being held in an unknown location by an enemy combatant who represents an ideology, not a country. Plus, the Taliban's offer for a prisoner swap goes against U.S. policy to not negotiate with terrorists. The VFW knows that pinning down his location and launching a successful rescue operation remains a top U.S. priority. We remain hopeful, and have communicated our support directly to the Bergdahl family.

TRICARE to Close 189 Walk-In FacilitiesOn April 1, TRICARE will close 189 walk-in facilities in the United States. The reason? The majority of beneficiaries use the Internet or phone to make changes, and closing the contractor-operated CONUS facilities would save $254 million over five years. The change does not affect TRICARE benefits or healthcare services, and overseas walk-in facilities will remain open. According to TRICARE officials, all of the administrative services that walk-in TSCs currently provide can be handled by TRICARE websites, mobile apps and toll-free phone centers. Beneficiaries can do the following on the TRICARE website:
  • Enroll in or purchase a plan
  • File a check or claim
  • View referrals and prior authorizations
  • Find a doctor
  • Change primary care managers
  • See what services and procedures are covered by their health plans
  • Compare plans
  • Manage prescriptions

New Service Members Mortgage ProtectionsThe Consumer Financial Protection Bureau (CFPB) has written new rules to protect service members and their families from serious financial challenges. According to CFPB, more than a third of the complaints from military families are mortgage-related, including poor mortgage servicing, sloppy lender recordkeeping and inconsistent foreclosure practices. Some of the changes being implemented will address the worst problems in the mortgage servicing industry, and provide new rights and protections to borrowers with an emphasis on military families. New Bergdahl Video SurfacesA new video surfaced this month showing Army Sgt. Bowe Bergdahl, the only known American service member being held against his will. It is the sixth known video to show him in captivity after being captured in eastern Afghanistan by the Taliban on June 30, 2009. They initially demanded $1 million and the release of 21 Afghan prisoners being held at Guantanamo Bay. The Taliban later reduced their demand to five prisoners in exchange for Bergdahl. This is an extremely difficult situation for the U.S. Government. Bergdahl is being held in an unknown location by an enemy combatant who represents an ideology, not a country. Plus, the Taliban's offer for a prisoner swap goes against U.S. policy to not negotiate with terrorists. The VFW knows that pinning down his location and launching a successful rescue operation remains a top U.S. priority. We remain hopeful and have communicated our support directly to the Bergdahl family.

1. Comprehensive Veterans Bill Needs Your Support: VFW-supported legislation to expand and improve healthcare and benefits for all generations of veterans and their families was introduced by Senate VA Committee Chairman Bernie Sanders (I-Vt.). S. 1950, the "Veterans Health and Benefits and Military Retirement Pay Restoration Act of 2014," fulfills many VFW's priority goals, to include expanding family caregiver benefits, in-state tuition rates and the veterans retraining assistance program, and would provide advance appropriations for mandatory VA accounts so that disabled veterans, survivors and GI Bill recipients would continue to receive their monthly payments regardless of future government shutdowns. The bill would also repeal the 1 percent COLA penalty on working-age military retirees younger than age 62. VFW National Commander Bill Thien called it "The most comprehensive veterans' legislation to be introduced in decades," and is now urging all VFW members and advocates to contact their members of Congress to support S. 1950. 2. VA Warns of Pension Poaching Scams: The VA is warning everyone of potential pension poaching scams. Be cautious if someone offers to move your assets around in order for you to qualify for VA pension. This type of scam is often directed toward veterans and family members who "do not" actually qualify for VA pensions. Other examples:

  • Organizations who cold-call veterans or survivors, charge money for assisting with a VA pension claim, and take credit card information from veterans over the telephone.
  • People who charge as much as $6,000 upfront to represent claimants before VA, with a percentage of any eventual back payment from VA as a portion of the ultimate fee.

VFW Legislative Alert: Urge Passage of Comprehensive Veterans' and Health Benefits Package Today!
Background:  Senate Veterans' Affairs Committee Chairman, Bernie Sanders introduced the Veterans Health and Benefits and Military Retirement Pay Resotration Act of 2014. The bill, S. 1950, is the most comprehensive veterans legislation to be introduced in decades. It addresses many of the VFW's legislative priority goals, including a full repeal of the military retiree one percent COLA reduction that penalizes working-age military retirees and their families.
If signed into law, this sweeping legislation would expand and improve health care and benefit services to all generations of veterans and their families. Most notably, it would expand the current caregiver law to include all generations of veterans and provide advance appropriations to ensure monthly compensation and pension as well as education payments are protected from future budget battles.  The bill also offers in-state tuition protection for recently transitioned veterans, improves access to mental health and treatment for victims of sexual assault in the military, and authorizes construction of more than 20 Community Bases Outpatient Clinics to serve veterans in rural and remote communities.
Action Needed:  Call and email your Senators today. urge them to pass S. 1950, the Veterans Health and Benefits and Military Retirement Restoration Act of 2014. Tell them that this historic legislation will provide vital services to all generations of veterans and their families. Remind them that past, present and future veterans have earned the critical services this legislation will provide.
